On 3 February 2026, the House of Lords voted in favour of a key amendment strengthening Benedict’s Law, marking a major step forward in protecting children with allergies in schools across England.
The amendment to the Children’s Wellbeing and Schools Bill commits the Government to introduce mandatory, statutory allergy safety guidance for all schools by September 2026.
What this means for schools:
✔️ Robust allergy and anaphylaxis policies
✔️ Individual Healthcare Plans (IHPs)
✔️ Spare, in-date adrenaline auto-injectors (AAIs) on site
✔️ Mandatory staff training to recognise anaphylaxis and administer adrenaline
This change follows campaigning by the Benedict Blythe Foundation, established after the tragic death of 5-year-old Benedict Blythe in 2021.
